Al Masri: Judicial Committee Aims at Ending Legal Problems, Not Implementing Sharia

The Palestinian ousted government headed by Ismail Haniya ordered the formation of a judicial committee in Gaza Strip to replace the ordinary courts after PA president Mahmoud Abbas suspended work of these courts since Hamas took control over Gaza.

The Palestinian ousted government headed by Ismail Haniya ordered the formation of a judicial committee in Gaza Strip to replace the ordinary courts after PA president Mahmoud Abbas suspended work of these courts since Hamas took control over Gaza.
 
Hamas spokesman, Sami Abu Zuhri, said that the target of the new judicial committee will not be implementing tenets of the Islamic Sharia, fears reinforced among human rights agencies after Hamas seized the Gaza Strip.. He pointed out that many Palestinians refer to Islamic Sharia, specially in issues of marriage, divorce and inheritance .
 
Abu Zuhri pointed out that the courts in the Gaza Strip resort to Islamic Sharia while dealing with such issues, confirming at the same time that this committee is temporary and that they only do they will continue till competent courts return to work .
 
For his part, the secretary general of the Hamas Change and Reform bloc in the Legislative Council, Mushir Al Masri, said in a statement to Ikhwanweb:" We have, in the Hamas movement in the Palestinian Legislative Council, repeatedly demanded a judicial independence. However, our demands weren’t met. The latest incidents made Hamas movement seek an alternative for the stalled courts in Gaza Strip.
 
"Courts" work is suspended and we need a body to run people"s daily affairs in Gaza. So, the government of Ismail Haniya carried out this step to solve the problem of the legal and judicial vacuum after the decision of president Mahmoud Abbas of suspending the work of the courts" said Al Masri.

Al Masri stressed that this judicial committee is temporary, that it does not aim at implementing Islamic Sharia and that it is not copycatting Islamic courts in Somalia for example.
 
"We respect the Palestinian law  and constitution and we do not seek the implementation of the Islamic Sharia under the current conditions facing the Palestinian people " added Al Masri.
