Administrative Court Issues Retrial in Appeal against MB Military

The appeals circuit at the Supreme Administrative Court issued on Monday its ruling over government appeal against ruling rejecting referring Muslim Brotherhood (MB) top leaders to a military tribunal.

The appeals circuit at the Supreme Administrative Court issued on Monday its ruling over government appeal against ruling rejecting referring Muslim Brotherhood (MB) top leaders to a military tribunal.
 
The Administrative court issued a retrial in the case and to send it to another circuit.
 
Observers see this ruling of a retrial and the delay in the first session of this retrial (first session on Jan, 21st, 2008) as a lag in issuing a ruling till the regime finishes the military trial of the MB leaders.
 
It is worth mentioning that the MB defense panel have appealed earlier in front of the administrative justice against decisions of assigning judges of the Supreme Court that issued Monday"s rulings, to ministries and government bodies, because these bodies represent the government, the key rival in the appeal. However, the administrative court"s ruling rejected the appeal, and backed assigning judges to government authorities, in contradiction to its neutrality and independence, according to Al-Masri Al-Yom in its Monday issue.
 
The Supreme Administrative Court issued in a previous session a preliminary ruling in the appeal, as it ordered implementing the administrative court"s ruling stopped and referring it the state court to issue a legal view, and rejected a retrial demanded submitted by the MB defense to reject a judge of the court for being assigned with the job of a legal advisor at the presidency.
The court session was headed by judge Essamuddin Abdul Aziz, the chief justice and judge Abdul Qader Qandil.
