Ruling On Challenge of MB Transferal To Military Trials, Presidential Pardon Postponed

The Administrative court decided postponing issuing its decision on the challenge presented by the Defense Authority of the Muslim Brothers transferred to military trials, primarily Khayrat El-Shater and his group, to the upcoming January 27.

Today, January 13, at noon, the Administrative court headed by Judge Mohamed Attia looked into the challenge against the Egyptian President"s decision of transferring civilians to military courts and exempting a number of those who"ve been transferred to military trials from the President"s decision of pardon issued last July concerned with releasing detainees after serving half their prison-term.

 

The Administrative court decided postponing issuing its decision on the challenge presented by the Defense Authority of the Muslim Brothers transferred to military trials, primarily Khayrat El-Shater and his group, to the upcoming January 27.

 

As for the ruling on the challenge against the President"s decision of exempting those transferred to military courts who"ve served half their prison term from the presidential pardon decision, which is invalid both constitutionally and legally, it was also postponed to the upcoming February 24.

 

It is mentioned that the court had postponed looking into the first challenge three times for the failure of the parties which the challenge was presented against to respond.  These parties are the Ministries of Justice, Defense, Interior, the Attorney General, Head of the Military Judicature Administration , Military Attorney General, Head of the Supreme Military Court, Minister of Interior Prison Sector Assistant, and Tora Prison Police Commissioner.
