The Misdemeanor Court chaired by Chancellor Mohamed El-Toni decided to reject the appeal submitted by the defense team against the decision to arrest Dr. Osama Nasr, of the MB Guidance Bureau, and 11 other MB members from the Beheira governorate. The court approved the decision of the Prosecution to detain them.
Detainees were handcuffed in the court room in which the defense team objected to and the court gave them two options either to unlock the handcuffs and put them in the defendants’ cage or let them sit in the court room and remain handcuffed.
Defendants rejected all charges against them. The detainees' defense team which included lawyers Ahmed el-Hamzawy and Nasser El-Hafee, argued that the court was not competent to decide on the appeal as the court which should be ruling is the one in the area of residency and area of arrest. The lawyers added that in actual fact the detentions were invalid since there were no legitimate or clear reasons for their arrests. No evidences were revealed.
Abdel Monem Abdel Maqsud stressed that ruling in this court is in violation of the law and the Constitution. He added that this should have been considered by the court even if the defense did not mention it. |
